All
legal claim have a time limit to have a suit filed and have the
Defendant served.
In Georgia, for most negligence actions, an adult
has two (2) years to make a claim.
In Medical Malpractice, if the injury occurred at
birth, the parents have two (2) years, and the child’s claim
continues for five (5) years.
It is advisable to have suit filed in order to collect
for the parent’s claim which includes medical expenses up
to the age of 18.
If surgery was involved in a malpractice, suit should
be filed within two (2) years of the incident.
There is no advantage to waiting, and you should seek
professional assistance. Witnesses tend to forget and cannot be
located, so an early statement from a witness can be crucial to
your case.
If suit can be filed within the first year of the
incident, it will be settled that much sooner and resolved. Time
